Obesity equates disability

By decision of the European Court, obesity, under certain circumstances, may cause a person suffering from overweight to become disabled.

The lawyers came to such a decision during the consideration of the claim of the Danish educator Carsten Kaltoft, who claims that he was dismissed because of his excess weight. According to the administration of the children's institution, the 160-pound Caltoft is so thick that it is not able to tie the laces on the shoes to the children.

The court ruled that if obesity prevents an employee from working fully and effectively, it can become a basis for recognizing a person as disabled.

Separately, it was agreed that obesity is not a disability. However, if it leads a person to long-term disability, then the law on the protection of the rights of persons with disabilities comes into force.

Recall that the decisions rendered by the European Court of Justice are binding on all EU countries.
